This article explains in which cases customs may detain consignments from third countries, which goods are prohibited or restricted, and which legislation governs these provisions.
When customs may detain a consignment
Where goods being brought into or sent to Lithuania from third countries may be subject to prohibitions or restrictions, customs has the right to detain them.
Goods may be detained where there is suspicion that:
- intellectual property rights are being infringed
- substances of unclear origin, narcotic, psychotropic or hazardous substances are being sent
- weapons are being sent
- goods protected under the CITES Convention are being sent
- other prohibited or restricted items are being sent
How the detention of goods takes place
The procedure for the detention of goods by the Lithuanian customs is governed by the Description of the Procedure for the Detention of Goods, Vehicles Carrying Them and Other Items and/or Cash by the Customs of the Republic of Lithuania (hereinafter – the Description).
When goods are detained:
- a goods detention record is drawn up
- the record states the grounds for detention, the circumstances and the legislation that may have been infringed
- a copy of the record is handed to the person who presented the goods for customs examination
- that person informs the recipient of the consignment of the detention of the goods
Important. The time limits for the detention of goods are not established, except in the cases referred to in point 11 of the Description.
The investigation at the territorial customs office is carried out until all the circumstances of the specific case have been established. Customs informs the relevant persons of the decision taken.
Key prohibitions: food products from Russia and Belarus
It is prohibited to import, bring in or send by consignment to Lithuania from Russia and Belarus:
- food products, including:
- tobacco products
- alcoholic beverages
- food supplements
It is also prohibited to import or send by consignment from those states goods listed in:
- the Annexes to Council Regulation (EC) No 765/2006
- the Annexes to Council Regulation (EU) No 833/2014
Key prohibitions: tobacco products and electronic cigarettes
In Lithuania, distance selling of tobacco products and tobacco-related products is prohibited. The prohibition applies to:
- online sales within Lithuania
- online sales from other countries
- sending by post or courier
Tobacco-related products include:
- electronic cigarettes
- electronic cigarette refills
- herbal products for smoking
This means that natural persons are prohibited from:
- purchasing these products in online shops
- sending tobacco, tobacco products or tobacco-related products to Lithuania
Where such goods are found in consignments, customs detains them.
Key prohibitions: food supplements
One person is permitted to carry or send:
- no more than 10 primary packaging units of food supplements or special foodstuffs
- with a total weight not exceeding 20 kg
